LIMITATION OF LIABILITY POLICY
1. Introduction
LUNEXA ("Company", "LUNEXA ", "We", "Us", "Our"), a proprietorship concern, with Udyam Registration No : UDYAM-KR-11-0080406 , having its principal place of business at Ground Floor, Hiranya Complex, Bolwar, Puttur, Dakshina Kannada, Karnataka – 574201, India, owns and operates the e-commerce platform accessible through shop.motoutility.com, a MOTOUTILITY Trademark owned by LUNEXA and associated digital services (collectively referred to as the "Platform")
This Limitation of Liability Policy ("Policy") governs and limits the liability of shop.motoutility.com, a Proprietorship Firm, in relation to the products and services offered through its website and mobile application ("Platform").
This Policy shall be read in conjunction with the Terms and Conditions, Warranty Policy, Disclaimer Policy, Return and Refund Policy and other policies published on the Platform.
2. Applicable Laws
This Policy has been framed in accordance with:
a) The Motor Vehicles Act, 1988;
b) The Central Motor Vehicles Rules, 1989;
c) The Consumer Protection Act, 2019;
d) The Consumer Protection (E-Commerce) Rules, 2020;
e) The Information Technology Act, 2000;
f) The Indian Contract Act, 1872;
g) The Sale of Goods Act, 1930;
h) The Digital Personal Data Protection Act, 2023;
i) All other applicable laws and regulations.
3. Nature of Business
shop.motoutility.com is engaged in the business of retail sale and distribution of automotive spare parts, vehicle accessories, artistic number plate accessories and related products.
shop.motoutility.com does not manufacture motor vehicles and shall not be responsible for defects attributable to vehicle manufacturers or third-party manufacturers.
4. Compliance with the Motor Vehicles Act, 1988
shop.motoutility.com conducts its business in accordance with the provisions of the Motor Vehicles Act, 1988 and the Central Motor Vehicles Rules, 1989.

5. No Sale of High Security Registration Plates
shop.motoutility.com expressly declares that it does not manufacture, issue, supply or sell High Security Registration Plates (HSRP) regulated under Rule 50 of the Central Motor Vehicles Rules, 1989.
The Platform does not claim to be an authorized HSRP vendor or government-approved registration plate manufacturer.
Any artistic, decorative or display products offered through the Platform are intended solely for aesthetic, novelty or accessory purposes and shall not be construed as substitutes for legally mandated registration plates.
6. No Sale of Restricted or Prohibited Products
shop.motoutility.com does not sell or promote products whose manufacture, sale, possession or use is prohibited or restricted under applicable laws.
The Company reserves the right to refuse or cancel transactions involving products or activities which may violate:
a) Motor Vehicles Act, 1988;
b) Central Motor Vehicles Rules, 1989;
c) Consumer Protection Act, 2019;
d) Information Technology Act, 2000;
e) Any law for the time being in force.
7. Artistic Number Plate Disclaimer
Artistic number plate accessories, decorative frames, stickers and display products sold through the Platform are not intended to replace government-issued registration plates. shop.motoutility.com shall not be liable for:
a) Traffic penalties;
b) Vehicle seizure;
c) Prosecution;
d) Suspension of registration;
e) Regulatory action;
f) Fines imposed by authorities;
arising out of misuse or illegal use of such products by customers.
The customer shall remain solely responsible for ensuring compliance with Rule 50 of the Central Motor Vehicles Rules, 1989 and other applicable laws.
8. Product Compatibility
shop.motoutility.com shall not be liable for losses arising from:
a) Wrong product selection;
b) Incompatibility with vehicles;
c) Improper installation;
d) Unauthorized modifications;
e) Failure to follow manufacturer instructions.
Customers are advised to verify specifications and consult qualified mechanics before installation.
9. No Liability for Road Accidents and Injuries
shop.motoutility.com shall not be responsible for:
a) Accidents;
b) Personal injuries;
c) Death;
d) Property damage;
e) Vehicle malfunction;
f) Loss of use of vehicles;
g) Consequential losses;
arising from improper installation, negligent use, unauthorized modifications or misuse of products purchased through the Platform.
10. Third-Party Manufacturer Liability
Many products available on the Platform are manufactured by independent third parties.

13. Force Majeure

16. Severability
If any provision of this Policy is declared invalid, illegal or unenforceable by a court or competent authority, the remaining provisions shall continue to remain valid and enforceable.
