This PRODUCT POLICY is called VEHICLE NUMBER PLATE COMPLIANCE POLICY.
LUNEXA, a proprietorship concern with Udyam Registration No : UDYAM-KR-11-0080406 , having its principal place of business at Ground Floor, Hiranya Complex, Bolwar, Puttur, Dakshina Kannada, Karnataka – 574201, India (hereinafter referred to as "LUNEXA", "Company", "We", "Us" or "Our"), operates the e-commerce platform shop.motoutility.com ("Platform") a MOTOUTILITY Trademark owned by LUNEXA .
This Vehicle Number Plate Compliance Policy ("Policy") governs the purchase, manufacture, customization, sale, supply, delivery, installation, possession, and use of vehicle registration plates, number plate frames, registration plate accessories, mounting kits, decorative plate products, and related automotive products offered through the Platform.
1. PURPOSE OF POLICY
This Vehicle Number Plate Compliance Policy ("Policy") governs the purchase, manufacture, customization, supply, sale, and use of vehicle number plates, registration plates, number plate frames, registration plate accessories, and related products offered through shop.motoutility.com ("Platform").
This Policy is intended to ensure compliance with the provisions of the Motor Vehicles Act, 1988, the Central Motor Vehicles Rules, 1989, including amendments relating to registration marks and High Security Registration Plates (HSRP), and all other applicable laws, rules, notifications, orders, and governmental guidelines issued from time to time.
By purchasing, ordering, or using any number plate-related product from the Platform, the User expressly agrees to comply with this Policy.
2. LEGAL COMPLIANCE OBLIGATION OF CUSTOMER
The Customer acknowledges that the display, installation, use, format, size, font, colour, illumination, positioning, and specifications of vehicle registration marks are regulated by law.
The Customer shall be solely responsible for ensuring that any number plate, frame, accessory, sticker, holder, or related product purchased from the Platform complies with:
(a) The Motor Vehicles Act, 1988;
(b) The Central Motor Vehicles Rules, 1989;
(c) Rules relating to High Security Registration Plates (HSRP);
(d) State Transport Department regulations;
(e) Directions issued by courts, transport authorities, or law enforcement agencies;
(f) Any future amendments or regulatory requirements.
Moto Utility does not undertake any responsibility to verify whether the Customer's intended use complies with applicable law.
3. NO SUBSTITUTE FOR GOVERNMENT-APPROVED REGISTRATION PLATES
The number plates, plate frames, decorative plates, display plates, novelty plates, show plates, and related products sold through the Platform are not represented as substitutes for any government-authorized registration plate unless expressly stated.
Where High Security Registration Plates (HSRP) are mandatory under law, the Customer shall obtain and install the same only through authorized government-approved vendors.
Nothing sold on the Platform shall be construed as an authorization to replace, modify, alter, conceal, tamper with, duplicate, counterfeit, or circumvent any legally mandated registration plate.
4. ACCURACY OF INFORMATION PROVIDED BY CUSTOMER
The Customer represents and warrants that all information, registration numbers, vehicle details, identification particulars, customization instructions, and supporting documents submitted to Moto Utility are true, accurate, lawful, and belong to the Customer or are used with lawful authorization.
The Customer shall not submit:
(a) False registration numbers;
(b) Misleading vehicle details;
(c) Impersonated vehicle information;
(d) Offensive or unlawful content;
(e) Government-restricted symbols or insignia;
(f) Any material prohibited by law.
The Customer shall remain solely liable for any consequences arising from incorrect information supplied.
5. PROHIBITED USES
Products purchased from the Platform shall not be used for:
(a) Concealing vehicle identity;
(b) Evading traffic enforcement systems;
(c) Avoiding toll collection systems;
(d) Misrepresenting vehicle ownership;
(e) Displaying unauthorized registration marks;
(f) Creating duplicate registration plates;
(g) Fraudulent activities;
(h) Criminal activities;
(i) Impersonation of government vehicles;
(j) Tampering with HSRP plates;
(k) Any unlawful purpose whatsoever.
Any such use shall constitute a material violation of this Policy.
6. NUMBER PLATE FRAME AND ACCESSORY DISCLAIMER
Number plate frames, covers, holders, brackets, decorative accessories, mounting kits, and related products are supplied solely as accessories.
The Customer shall ensure that such accessories do not:
(a) Obstruct visibility of registration marks;
(b) Cover state identifiers;
(c) Conceal HSRP features;
(d) Obstruct holograms;
(e) Obstruct laser codes;
(f) Interfere with enforcement cameras;
(g) Violate applicable regulations.
Moto Utility shall not be liable for any penalty, prosecution, seizure, impoundment, or enforcement action resulting from installation or use of such accessories.
7. HSRP COMPLIANCE DISCLAIMER
Where applicable law requires installation of a High Security Registration Plate (HSRP), the Customer shall independently ensure compliance.
Moto Utility does not certify, represent, warrant, or guarantee that any product offered on the Platform qualifies as an HSRP unless specifically identified as such by an authorized governmental approval process.
The responsibility for obtaining and maintaining lawful HSRP compliance rests exclusively with the vehicle owner.
8. LAW ENFORCEMENT AND REGULATORY ACTIONS
Moto Utility shall not be liable for:
(a) Traffic challans;
(b) Vehicle seizures;
(c) Vehicle impoundment;
(d) Registration suspension;
(e) Cancellation of permits;
(f) Police investigations;
(g) Regulatory penalties;
(h) Court proceedings;
(i) Any governmental action arising from use of products purchased from the Platform.
All such liabilities shall remain exclusively with the Customer.
9. RIGHT TO REFUSE ORDERS
Moto Utility reserves the absolute right, without assigning any reason, to reject, suspend, cancel, refuse, or discontinue any order involving number plates or customized products where:
(a) Fraud is suspected;
(b) Legal compliance concerns arise;
(c) Documentation appears inaccurate;
(d) Regulatory restrictions apply;
(e) The requested content may violate law or public policy;
(f) The Company believes fulfillment may expose it to legal risk.
The Company's decision shall be final and binding.
10. INDEMNITY
The Customer agrees to indemnify, defend, and hold harmless Moto Utility, Lunexa, its proprietor, employees, officers, representatives, affiliates, vendors, successors, and assigns against all claims, penalties, fines, liabilities, damages, losses, costs, legal expenses, and proceedings arising out of:
(a) Violation of this Policy;
(b) Unlawful use of products;
(c) Breach of motor vehicle laws;
(d) Submission of false information;
(e) Misuse of registration-related products;
(f) Any third-party claim arising from the Customer's conduct.
11. LIMITATION OF LIABILITY
To the maximum extent permitted under law, Moto Utility shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or regulatory damages arising from the purchase, installation, possession, display, modification, customization, or use of number plate products.
In all circumstances, the aggregate liability of Moto Utility shall not exceed the actual purchase price paid by the Customer for the concerned product.
12. POLICY AMENDMENTS
Moto Utility reserves the unrestricted right to amend, modify, replace, update, suspend, or withdraw this Policy at any time to reflect changes in applicable law, governmental directives, industry standards, or business requirements.
Continued use of the Platform following publication of revised terms shall constitute acceptance of such amendments.
13. GOVERNING LAW
This Policy shall be governed by and construed in accordance with the laws of India, including the Motor Vehicles Act, 1988, the Central Motor Vehicles Rules, 1989, the Consumer Protection Act, 2019, the Information Technology Act, 2000, and all applicable regulations in force from time to time.
Any dispute arising under this Policy shall be subject to the exclusive jurisdiction of the competent courts situated at Puttur/Mangalore , Dakshina Kannada, Karnataka.
