WARRANTY POLICY
1. Introduction
LUNEXA ("Company", "LUNEXA ", "We", "Us", "Our"), a proprietorship concern, with Udyam Registration No : UDYAM-KR-11-0080406 , having its principal place of business at Ground Floor, Hiranya Complex, Bolwar, Puttur, Dakshina Kannada, Karnataka – 574201, India, owns and operates the e-commerce platform accessible through shop.motoutility.com, a MOTOUTILITY Trademark owned by LUNEXA and associated digital services (collectively referred to as the "Platform").
This Warranty Policy ("Policy") governs the terms and conditions relating to warranties provided in respect of products sold through the website and mobile application "shop.motoutility.com" , owned and operated by LUNEXA , a Proprietorship Firm.
This Policy has been framed in accordance with the provisions of the Consumer Protection Act, 2019, Consumer Protection (E-Commerce) Rules, 2020, Sale of Goods Act, 1930, Indian Contract Act, 1872, Information Technology Act, 2000, Motor Vehicles Act, 1988, and other applicable laws in force in India.

2. Scope of Policy
This Policy applies to all automotive spare parts, vehicle accessories, electrical components, lubricants and related products purchased through the Platform.
The Policy governs:
a) Manufacturer warranties;
b) Limited warranties provided byshop.motoutility.com ;
c) Conditions for warranty claims;
d) Exclusions from warranty coverage;
e) Replacement and repair procedures;
f) Rights and obligations of customers and the Company.
3. Definitions
For the purposes of this Policy:
(a) "Product" means any spare part, accessory, equipment or automotive component sold through the Platform.
(b) "Warranty" means a limited assurance regarding the quality and performance of the product under specified conditions.

4. Nature of Warranty

5. Warranty Coverage

8. Compliance with Motor Vehicles Act, 1988
In accordance with the Motor Vehicles Act, 1988 and public safety principles, customers are advised to install vehicle components through qualified mechanics or authorized service centres.

a) Improper installation;
b) Unauthorized modifications;

Nothing contained herein shall be construed as authorizing modifications prohibited under the Motor Vehicles Act, 1988 or any rules framed thereunder.
9. Exclusions from Warranty
Warranty shall not cover:
a) Normal wear and tear;
b) Damage caused by accident or collision;
c) Improper installation;
d) Unauthorized repairs;
e) Negligence or misuse;
f) Exposure to water, fire, chemicals or excessive heat;
g) Electrical fluctuations or short circuits;
h) Physical damage after delivery;
i) Corrosion or rusting;
j) Tampering with serial numbers or labels;
k) Use for racing, commercial abuse or illegal purposes;
l) Defects arising from modifications contrary to the Motor Vehicles Act, 1988.
10. Electrical and Electronic Components
Electrical and electronic components including sensors, switches, ECU modules, relays and similar products are highly sensitive products.
Accordingly, warranty claims relating to such products shall be subject to technical inspection and testing.
No warranty shall apply where failure is caused by incorrect installation, voltage fluctuations or external factors.
11. Procedure for Warranty Claims
Customers seeking warranty benefits shall:
a) Contact customer support;
b) Provide invoice and order details;
c) Submit photographs, videos or other evidence;
d) Return the product if required;
e) Cooperate with inspection and technical evaluation.

12. Inspection and Verification

15. Consumer Rights
Nothing contained in this Policy shall restrict or curtail statutory rights available under:
a) Consumer Protection Act, 2019;
b) Consumer Protection (E-Commerce) Rules, 2020;
c) Sale of Goods Act, 1930;
d) Indian Contract Act, 1872;
e) Motor Vehicles Act, 1988;
f) Any other applicable law.
Customers shall have the right to seek remedies before the appropriate Consumer Disputes Redressal Commission and other competent authorities.
16. Fraudulent Claims
shop.motoutility.com reserves the right to reject and take appropriate legal action against customers making:
a) False claims;
b) Fraudulent representations;
c) Fabricated evidence;
d) Misleading statements;
e) Abuse of warranty benefits.
17. Force Majeure
shop.motoutility.com shall not be liable for any delay or inability to honour warranty obligations arising from events beyond its reasonable control, including natural disasters, strikes, transportation disruptions, war, governmental restrictions, pandemics or force majeure events.
18. Amendment of Policy
shop.motoutility.com reserves the right to amend, modify or revise this Policy from time to time to ensure compliance with legal requirements and business necessities.
Updated versions shall be published on the Platform and shall become effective immediately upon publication.
19. Governing Law and Jurisdiction
This Policy shall be governed by the laws of India.
